Terms of Service

These Terms of Service ("Agreement") govern the relationship between WebCraft Wizards ("Company," "we," "us," or "our") and the client ("Client," "you," or "your") who engages our web design and development services. By booking a consultation, making a payment, or engaging our services in any form, you agree to be bound by this Agreement in full.

1. Services

WebCraft Wizards provides custom website design, development, and related digital services as described in the applicable service package selected by the Client. The specific deliverables, timelines, and pricing are defined at the time of purchase or written agreement. Any services not explicitly included in the selected package are considered out of scope and will be quoted separately.

We reserve the right to decline any project at our sole discretion, including but not limited to projects involving illegal activity, harmful content, or material that conflicts with our values.

2. Payment Terms

A non-refundable deposit of 50% of the total project cost is required before any work commences. The remaining balance is due in full prior to the delivery of the final website files, live deployment, or transfer of ownership — whichever occurs first. No final deliverables will be released until full payment has been received and cleared.

All prices are quoted in U.S. Dollars (USD). Invoices not paid within 7 days of the due date may incur a late fee of 1.5% per month on the outstanding balance. We reserve the right to suspend or terminate work on any project with an outstanding balance.

3. Refund Policy

All deposits are non-refundable. Once work has commenced, no refunds will be issued for any portion of the project fee, including the deposit. If the Client wishes to cancel the project after work has begun, the Client remains responsible for payment of all work completed up to the date of cancellation, which may exceed the initial deposit.

In the event that WebCraft Wizards is unable to complete the project due to circumstances within our control, a pro-rated refund for work not yet performed will be issued at our discretion.

4. Revisions & Scope of Work

Each package includes a defined number of revision rounds as specified at the time of purchase. A "revision" is defined as a minor adjustment to existing design or content — such as changing colors, fonts, text, or layout within the agreed scope. Requests that constitute new features, additional pages, or significant redesigns are considered out-of-scope work and will be quoted and billed separately.

Revision requests must be submitted in writing (email or through the client portal) within 14 days of the initial delivery. Requests submitted after this window may be treated as new work and billed accordingly.

5. Client Responsibilities

The Client is responsible for providing all required content — including but not limited to text, images, logos, branding assets, and login credentials for third-party services — within 5 business days of project kickoff. Delays in providing content will extend the delivery timeline accordingly, and WebCraft Wizards shall not be held liable for missed deadlines caused by the Client's failure to provide materials on time.

The Client warrants that all content provided to WebCraft Wizards is owned by the Client or that the Client has the legal right to use it. The Client assumes full responsibility for any copyright, trademark, or intellectual property claims arising from content they supply.

6. Intellectual Property

All design work, code, and creative assets produced by WebCraft Wizards remain the exclusive property of WebCraft Wizards until full payment has been received. Upon receipt of final payment, the Client is granted full ownership of the completed website, including all custom design files and code, subject to the terms of this Agreement.

WebCraft Wizards retains the right to display completed work in our portfolio, on our website, and in marketing materials unless the Client requests otherwise in writing prior to project completion.

7. Hosting & Third-Party Services

If WebCraft Wizards arranges or manages hosting on behalf of the Client, the Client acknowledges that hosting fees are subject to change based on pricing set by third-party hosting providers. Any increase in hosting costs will be passed directly to the Client with a minimum of 30 days' written notice. WebCraft Wizards is not responsible for price changes, service interruptions, or policy changes imposed by third-party hosting or infrastructure providers.

The Client is responsible for maintaining their own domain registration, SSL certificates, and any third-party subscriptions (e.g., email services, payment processors, CRM tools) unless explicitly included in the agreed scope of work.

8. Delivery Timeline

Advertised delivery timelines (e.g., "1–3 Day Delivery") are estimates that begin only after the Client has provided all required content, assets, and approvals, and the deposit has been received. These timelines are contingent on timely Client cooperation and are not guaranteed delivery dates. WebCraft Wizards will make reasonable efforts to meet stated timelines but shall not be liable for delays caused by Client inaction, third-party service outages, or circumstances beyond our control.

9. Limitation of Liability

To the maximum extent permitted by applicable law, WebCraft Wizards shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of revenue, loss of profits, loss of data, loss of business, or loss of goodwill, arising out of or in connection with our services, even if we have been advised of the possibility of such damages.

Our total liability to the Client for any claim arising under this Agreement shall not exceed the total amount paid by the Client to WebCraft Wizards for the specific project giving rise to the claim.

10. Warranties & Disclaimer

WebCraft Wizards warrants that all work will be performed in a professional manner consistent with industry standards. However, we make no guarantees regarding specific business outcomes, search engine rankings, conversion rates, or revenue generated from the delivered website. All services are provided "as is" and "as available" without warranty of any kind beyond what is expressly stated in this Agreement.

11. Confidentiality

Both parties agree to keep confidential any proprietary or sensitive information shared during the course of the project. WebCraft Wizards will not disclose Client business information, login credentials, or project details to third parties without the Client's written consent, except as required by law.

12. Dispute Resolution

In the event of a dispute, both parties agree to first attempt resolution through good-faith negotiation. If a resolution cannot be reached within 30 days, the dispute shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association (AAA). This Agreement shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions.

13. Termination

Either party may terminate this Agreement with written notice if the other party materially breaches any provision of this Agreement and fails to cure such breach within 10 business days of receiving written notice. Upon termination, the Client shall pay for all work completed up to the termination date. No refunds will be issued for work already performed.

14. Amendments

WebCraft Wizards reserves the right to update these Terms of Service at any time. Changes will be posted on this page with an updated "Last Updated" date. Continued use of our services after any such changes constitutes your acceptance of the new terms. For active projects, material changes will be communicated to the Client directly.

15. Entire Agreement

This Agreement, together with any project-specific proposal or invoice, constitutes the entire agreement between WebCraft Wizards and the Client with respect to the subject matter hereof, and supersedes all prior or contemporaneous communications, representations, or agreements, whether oral or written.
